StaySage Terms of Service

Effective October 27, 2026.

Your agreement with StaySage

StaySage is a California-based sole-proprietor business providing reporting services for independent motel and small-hotel operators. In these terms, “StaySage,” “we,” and “us” mean the business operating under the StaySage name; “you” means the customer purchasing the service. Contact us at support@getstaysage.com for service and billing questions or legal@getstaysage.com for legal notices.

The service is for business use by adults authorized to act for the relevant property or business. By affirmatively accepting these terms when subscribing, you agree to them and the Cancellation and Refund Policy. If you subscribe for an organization, you represent that you can bind that organization. The Privacy Notice explains our handling of personal information; accepting these terms does not by itself provide consent to optional advertising or analytics tracking.

What the subscription provides

StaySage organizes supported night-audit summary reports into a dashboard. Available metrics depend on your report and may include room revenue, rooms sold, occupancy, average room rate, and comparisons across dates or subscribed properties. History accumulates from the reports available to us. Historical imports, particular integrations, additional analysis, and custom work are included only if expressly agreed in writing.

Dashboard examples and calculator results on our website are illustrations, not your property's actual results or forecasts. A subscription does not include automatic room-price changes, a property-management system, guaranteed revenue improvement, or professional accounting, tax, legal, or investment advice.

Setup and reporting expectations

We will contact you within 48 hours after successful payment with setup instructions. We will deliver your first dashboard within five calendar days after receiving a usable report for the subscribed property.

A usable report has the date, property identification, and legible summary totals needed to produce the agreed dashboard, in a format we can process, without prohibited guest or payment information. We will explain material missing information or format problems promptly. The five-day setup period starts when those necessary inputs are available; we will not treat an ordinary clarification as permission to postpone setup indefinitely.

After setup, we aim to make a newly received usable night audit available in your dashboard within one hour. This is a best-effort processing target, not a guaranteed service level, an uptime warranty, or a credit schedule. Missing data, exceptional processing issues, maintenance, and third-party interruptions can cause delays. We will communicate material known interruptions affecting your service.

If your report is unsupported, we will cancel the affected property's subscription and refund its entire first payment. If we miss the initial five-day delivery commitment, you may choose to continue with a revised timeline or cancel the affected property for a full first-payment refund before initial delivery. No additional charge is required to receive that refund. See the cancellation policy for the full process.

Price, billing, and renewal

The price is USD 79 per property per month, plus applicable taxes disclosed at checkout. There is no free trial. The first payment is taken at purchase, including the setup period, and the subscription automatically renews monthly until canceled. The checkout and receipt identify the purchased property quantity, total price, and renewal details. Additional properties require your authorization and the additional charge shown before purchase.

By giving affirmative agreement to recurring billing at checkout, you authorize our payment processor, Stripe, to charge your chosen payment method for the disclosed recurring amount. You are responsible for using an authorized payment method and maintaining accurate billing information. We do not receive your full card number from Stripe.

We may suspend paid access after a failed payment and reasonable notice, subject to applicable law. We will not represent a failed payment as a completed purchase. We will not knowingly charge a further renewal for initial setup that we have failed to complete; we will pause or cancel that property's renewal and explain your refund options.

For a price increase or other material recurring-billing change, we will provide at least 30 days' advance notice, and any longer or additional notice required by applicable law. A change applies prospectively and you may cancel before it takes effect. We will obtain renewed consent when required. A price change will not retroactively alter a paid period.

Cancellation and refunds

You may stop future renewals at any time through the online billing-management link supplied with your subscription or by emailing support@getstaysage.com from your billing address. You do not need to call, explain your reason, or accept a retention offer. Cancellation stops future renewal charges and normally leaves access available through the paid period.

Our Cancellation and Refund Policy controls refund eligibility. It provides full first-payment refunds for unsupported reports and the initial-delivery failure described above, corrections for our duplicate or post-cancellation charges, and any refund required by law. Outside those cases, paid monthly periods are generally not prorated for unused time, a change of mind, or your decision not to send reports.

Billing questions and payment disputes

If you do not recognize a charge or believe something went wrong, please contact support@getstaysage.com so we can investigate and correct it. Include the billing email, charge date, and a short description; do not send your card number. Contacting us is an available resolution route, not a condition on exercising rights with your bank or payment provider.

We may give Stripe, card networks, banks, or other parties handling a payment dispute relevant transaction, consent, cancellation, service-delivery, and customer-communication records. We will limit those disclosures to what is reasonably needed to investigate or respond to the dispute and protect sensitive information.

A chargeback does not automatically cancel your subscription; you can separately cancel using the methods above. We will not continue collecting for a transaction that has been finally refunded or reversed unless there is a separate lawful basis to do so, and will not recover the same payment twice. We may reasonably suspend the affected paid service while an unresolved payment reversal is investigated, without blocking cancellation, refund requests, or legally required access.

These terms do not impose a chargeback penalty or waive a good-faith dispute right. Fraudulent conduct or a knowingly false representation is not authorized; we reserve remedies actually available under applicable law. We do not automatically pass processor dispute fees to you merely because you dispute a payment.

Your reports and account responsibilities

You retain your rights in the reports and information you submit. You give us permission to receive, store, process, reproduce, and display them as needed to provide, secure, troubleshoot, and support the service, using appropriate service providers. This is not a transfer of ownership or permission to publish your identifiable property data.

You are responsible for having authority to submit the reports and for their accuracy. Use summary reports. Do not submit guest names, guest contact details, booking numbers, card numbers, payment credentials, government identifiers, or other unnecessary sensitive personal information. If an attachment contains such information, remove it before sending. We may refuse or delete unsafe or inappropriate submissions and ask for a corrected report.

Keep access credentials secure and notify us of suspected unauthorized access. Do not attempt to access another customer's data, interfere with the service, distribute malware, misuse the service for unlawful activity, or resell access without our written agreement.

Ownership and permitted use

StaySage and its licensors retain rights in the service, software, original designs, documentation, and branding. During your paid subscription, you may use the service and your property's reporting outputs for your legitimate business operations. You may retain reports you lawfully export. You may not copy or redistribute our software or use our branding to imply an endorsement without permission.

Accuracy, availability, and changes

Reports depend on source data and can contain omissions, extraction errors, or later corrections. Check material figures against your original reports before acting on them. Tell us about discrepancies so we can investigate. You remain responsible for business decisions and for retaining original records; StaySage is not the sole archive for your property.

Except for the express commitments in these terms and rights that cannot be excluded, the service is provided as available, without implied warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation, to the maximum extent permitted by law. No disclaimer removes our express setup/refund commitments or excuses fraud or other liability that cannot lawfully be excluded.

We may make reasonable changes to the service. If we discontinue a material paid function or the service itself during a paid period without an equivalent substitute, we will provide a proportionate refund for the affected unused service. Material contract changes will be notified before taking effect; we will not use a website edit to retroactively remove accrued rights or refund eligibility.

Suspension and termination

We may restrict access as reasonably necessary for security, unlawful use, serious breach, or unpaid amounts. Where practicable and lawful, we will explain the issue and allow a reasonable opportunity to resolve it. You can still request cancellation and a lawful refund. If we end service for our convenience, we will refund the affected unused paid service. Any retention or deletion of customer information is governed by the Privacy Notice and applicable legal obligations.

Limits on liability

To the maximum extent permitted by law, neither party is liable under this agreement for indirect, incidental, special, exemplary, or consequential losses, including lost profits, lost business opportunities, or losses resulting from business decisions based on reports.

To the maximum extent permitted by law, StaySage's aggregate liability arising out of or relating to the service or this agreement is limited to the fees you paid to StaySage during the 12 months preceding the event giving rise to the claim. This limit does not restrict our express refund obligations or liability that applicable law prohibits limiting, including fraud, willful misconduct, or gross negligence where such limits are prohibited.

You are responsible for third-party claims caused by your unlawful submissions, lack of authority to provide customer data, or intentional misuse of the service. To the extent lawful, you will defend and indemnify StaySage against those claims and their reasonable resulting costs, excluding the extent caused by StaySage's own breach, negligence, or misconduct. We will give prompt notice, allow you reasonable control of the defense, and reasonably cooperate. No settlement may impose an admission or nonmonetary obligation on us without consent, not unreasonably withheld.

Governing law and general terms

California law governs this agreement, excluding conflict-of-laws rules, except where mandatory law requires otherwise. Nothing in these terms removes a nonwaivable statutory right, mandatory forum, or available small-claims procedure. These terms do not create mandatory arbitration or a class-action waiver.

The checkout order and these terms, including the incorporated cancellation policy, are the agreement for the service unless both parties expressly agree otherwise in writing. A specific written order controls a genuine conflict about its scope or price; no order silently removes statutory rights. If one provision cannot be enforced, the rest remains effective to the extent lawful. Neither party's delay in enforcing a provision waives it.

We may transfer the service to a successor operating business, including a company formed to continue StaySage, with notice and subject to applicable law, privacy obligations, and any required payment-provider process or customer consent. This does not authorize duplicate billing or guarantee that Stripe can migrate subscriptions automatically.
